General terms and conditions of sale


 1. General
 
These general terms and conditions of sale, presented here, regulate the offer, order acceptance, transmission and shipments made through the website www.piccolasperanza.com

Naughty Kid - Confecções Lda, hereinafter referred to as “Seller”, promotes and sells products of the Piccola Speranza brand on the website www.piccolasperanza.com

The individual who buys outside the scope of any business, as a final consumer, is referred to here as "Buyer". If you are not a final consumer, please contact us at info@piccolasperanza.com.

Whenever there are doubts as to the Buyer's final consumer quality or when orders do not respect the sales conditions presented herein, the Seller reserves the right not to process orders registered on the website www.piccolasperanza.com

The Buyer must provide the Seller with correct and complete data and agrees to be contacted by the Seller whenever he deems necessary.
 

2. Right not to accept the order or to cancel the purchase

The Seller reserves the right to cancel any order, exempt from any liability for damages and costs, even if it has already been confirmed, in the following situations:

- The product is no longer available;

- The billing information is not correct;

- The order was flagged as susceptible to fraud;

- The payment was not received within 2 working days after accepting the order;

- The Buyer is under 18 years of age;

- The Buyer is not an end consumer;

- The price indicated on the website is incorrect.

 
3. Data verification

Orders, after being received, will be subject to a verification of the credibility of the data presented. Suspected fraud will be reported to the appropriate authorities.
 

4. Payment methods

Only the forms of payment presented in the section “How can I place an order?” at www.piccolasperanza.com will be accepted.
 

5. Payment processing

After payment has been received, order processing will begin. Failure to pay within 2 business days will lead to automatic cancellation.


6. Reservation of title

The Seller retains ownership of the products until payment is made.


7. Prices

The prices shown in the online store are the final prices for sale to the consumer, with taxes already included and quoted in euros.

Product prices are subject to change. The Seller reserves the right to change prices without prior notice.

Although our online store is updated with extreme care, it is possible that the price information contains errors.

 
8. Quality and guarantee

Second-hand items are not sold on www.piccolasperanza.com. All products follow the same quality standards as the Piccola Speranza articles on the market.

The colors of the products presented in the online store may not exactly match the actual product, due to the Internet browser and monitor used.

All products have a label attached. If you intend to return the item, you should not remove this label. The Seller has the right not to accept the return of items without the corresponding label or that have been used, washed or even damaged.   
 

9. Deliveries

Deliveries are made from Monday to Friday.

A delivery is considered to have been made upon signature of the delivery receipt at the agreed address.

After leaving our warehouses, delivery must be made within a maximum period of up to 5 working days. Since deliveries are made by an external logistics company, the Seller cannot be held responsible for any delays in deliveries. Holidays, bridges or festive events may delay deliveries.

Upon delivery, the Buyer must inspect the packaging in order to ascertain any damage. If you find that the packaging has been tampered with, you should not accept the order. The Seller will refund the amounts paid for the order as soon as the warehouse receives and completes the return process.

After receiving the order, the Buyer must analyze the products within a period of 15 days. If they are not rejected within this period of time, the Seller will validate the acceptance of the products by the Buyer and will not accept any subsequent return.


10. Shipping charges

Shipping charges are applied per order. All shipments are carried out by CTT. National shipping costs 6,50 euros. For international shipments, the cost of transportation is 20,00 euros.

These fees will be shown before paying your order.

For purchases over 100,00 euros, with delivery in Portugal, postage will be free.


11. Returns and cancellations

As long as the order has not yet been shipped, the Buyer can cancel it without any associated cost. To do this, you should contact the Seller and ask for its cancellation. If the cancellation request is accepted, the Buyer will be notified by email of this decision and the cancellation will be processed free of charge. If the cancellation request is not accepted, the products will go to the Buyer who, keeping the intention to cancel the order, must refuse to receive it. Products will be returned and refunds will be processed. In this case, we alert you to the fact that shipping costs originated by the non-acceptance of the order will be borne by the Buyer.

In cases of defective items, the Seller will refund the Buyer.

We do not exchange items. If, for any reason, the Buyer wishes to exchange the product he received for another one, he must make a return and place a new order. In this case, the postage associated with the return will be borne by the Buyer.
  

12. Refunds
 
Refunds are made based on the payment method used. The Buyer will receive a refund after the return process is complete. The Seller has 15 working days, after receiving the order at its premises, to proceed with the refund.


13. Availability

The satisfaction of orders registered in the online store is subject to product availability. The Seller tries to ensure that the items present in the store for sale are in stock. However, the Seller reserves the right to cancel orders, even if they have already been confirmed, should the items become unavailable. In this case, the Buyer will be notified of the situation and a refund of the amount paid will be preceded.

 
14. Validity of promotions

The promotions presented on the website are only valid for the periods in which they are displayed.

Whenever there are errors or price misunderstandings, the Seller reserves the right to cancel any purchase and sale entered into under such errors.
 

15. Responsibility

The Seller cannot be held responsible for damages suffered by third parties resulting from the use of any of its products.

The Seller is not responsible for damages resulting from incorrect information on the website.
 

16. Applicable law

The present general conditions and all emerging disputes related to them, must be governed by Portuguese law.
 

17. Alteration of the General Terms and Conditions of Sale

The Seller has the right to change the General Terms and Conditions of Sale at any time and without prior notice. The Buyer is subject to the principles and terms in force on the date of his order, unless the law or the competent authority imposes any changes to them.  
 

18. Information on the website
 
Piccola Speranza works with care on its website. However, text, graphic documents, films, music and other services may contain errors or be incomplete. The Seller cannot be held responsible for damages resulting from the use or inability to use the website.
